Child Support Extortion

Do I have to pay child support if my ex keeps me away from my kids?


Yes. Child support should not be confused with custody and visitation. Every parent has an obligation to support his or her children. With one narrow exception, no state allows a parent to withhold support because of disputes over visitation. The exception? If the custodial parent disappears for a lengthy period so that no visitation is possible, a few courts have ruled that the noncustodial parent's duty to pay child support may be considered temporarily suspended.
No matter what the circumstances, if you believe that your ex is interfering with your visitation rights, the appropriate remedy is to go back to court to have your rights enforced rather than to stop making support payments.

The South Carolina Retirement Systems has posted an updated Qualified Domestic Relations Order (QDRO) Model Order and Guidelines on its website.

The Model Order and Guidelines address all information that is required by statute and provides guidance on various methods of calculating the division of state retirement benefits from the defined benefit plans (not 401(k) or 457 plans).

Although it is not required that a QDRO be prepared identically to the Model Order and Guidelines, conformance will make the approval process quicker and easier and will provide accuracy for future implementation of the QDRO.

This modal "may' be used in other states as well; particularly where your state does not have specific guidelines.

Parental Alienation Syndrome

The Parental Alienation Syndrome (PAS) is the systematic denigration by one parent by the other with the intent of alienating the child against the other parent.

The purpose of the alienation is usually to gain or retain custody without the involvement of the father. The alienation usually extends to the father's family and friends as well.

Alex Baldwin Situation

Actor ALEC BALDWIN is planning to tackle California’s “dysfunctional” custody laws in a new book after settling his latest court spat with ex-wife KIM BASINGER.

The movie star dragged Basinger through the courts in Los Angeles in November (05) and earlier this month (DEC05) fighting for more custody of their daughter IRELAND. And, although he has agreed a settlement with his ex, Baldwin is still far from happy.

In court, the actor claimed Basinger has been trying to turn his daughter against him and violated a previous court-imposed visitation agreement this summer (05).

He says, “The specific details of what I’m going through, we’ve been instructed by judges, past and present, to not discuss that with the press. I’m in the middle of making a deal to write a book about it.”

In the book, Baldwin plans to attack the system and how father's are discriminated against.

He claims the law is stacked against civil conclusions, adding, “Conflict resolution for people is the last thing on the agenda.”

The National Brotherhood of Fathers Rights is seeking interested Fathers to participate in a class action civil rights, discrimination, lawsuit.

This action will be brought in Federal Court.
